Terms of Service

These Terms of Service (“Terms”) govern your access to and use of SaveCrazyDeals.com, the SaveCrazyDeals mobile applications for iOS and Android, and all related features, communications, content, and services we provide (collectively, the “Services”).

The Services are operated by Save Crazy Deals, doing business as SaveCrazyDeals (“SaveCrazyDeals,” “we,” “us,” or “our”).

PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE SERVICES, CREATING AN ACCOUNT, OR OTHERWISE INDICATING YOUR ACCEPTANCE OF THESE TERMS, YOU AGREE TO BE BOUND BY THEM.

THESE TERMS CONTAIN IMPORTANT DISCLAIMERS OF WARRANTIES, LIMITATIONS OF LIABILITY, AN AGREEMENT TO ARBITRATE CERTAIN DISPUTES, AND A CLASS-ACTION WAIVER.

1. What SaveCrazyDeals Does

SaveCrazyDeals helps users discover deals, coupons, promotions, discounts, products, services, pricing information, and links to third-party merchants.

Unless we expressly state otherwise, SaveCrazyDeals is not the seller, retailer, manufacturer, distributor, supplier, broker, payment processor, fulfillment provider, or merchant of record for products or services displayed through the Services.

Purchases and other transactions with third-party merchants are solely between you and the applicable merchant.

2. No Guarantee of Any Deal, Price, Coupon, or Savings

SAVeCRAZYDEALS DOES NOT GUARANTEE ANY DEAL, COUPON, PROMOTIONAL CODE, DISCOUNT, PRICE, SAVINGS AMOUNT, PRODUCT, SERVICE, INVENTORY, AVAILABILITY, MERCHANT, SHIPPING INFORMATION, OR OTHER INFORMATION DISPLAYED THROUGH THE SERVICES.

Deal information may come from merchants, affiliate networks, advertisers, automated systems, third-party providers, users, publicly available information, or other sources.

Such information may be incorrect, incomplete, delayed, outdated, misleading, unavailable, or contain technical, typographical, pricing, transmission, or other errors.

Without limiting the foregoing, we make no representation, warranty, promise, or guarantee that:

any deal, coupon, promotional code, rebate, or discount will work or be accepted;
a product or service will remain available;
an item will be in stock;
a displayed price will be the price charged by the merchant;
a deal will still exist when you click a link or attempt to make a purchase;
an expiration date or availability period is accurate;
a merchant will honor any advertised price, promotion, coupon, discount, or other offer;
a merchant will complete or fulfill a transaction;
a product will be delivered, delivered on time, or delivered as described;
a product or service is authentic, safe, legal, merchantable, suitable, effective, or of any particular quality;
product descriptions, photographs, specifications, ratings, reviews, shipping information, or other details are accurate;
any stated percentage or dollar savings is accurate;
a comparison price, list price, MSRP, “regular” price, “was” price, reference price, or similar figure represents a price at which the item was actually offered or sold;
a displayed deal is the cheapest, lowest, best, most valuable, or most favorable offer available;
you will save any particular amount of money;
taxes, shipping costs, service charges, membership requirements, minimum purchases, geographic restrictions, exclusions, or other conditions are reflected in the information we display;
a merchant is trustworthy, reputable, financially stable, legitimate, or suitable for you; or
any alert or notification will reach you before a deal changes, expires, or sells out.

DEALS, PRICES, INVENTORY, AND PROMOTIONS MAY CHANGE AT ANY TIME AND WITHOUT NOTICE, INCLUDING BETWEEN THE TIME YOU VIEW SOMETHING ON SAVeCRAZYDEALS AND THE TIME YOU VISIT OR COMPLETE A TRANSACTION WITH A MERCHANT.

You are responsible for verifying all important information directly with the merchant before purchasing.

If information displayed by SaveCrazyDeals conflicts with information displayed or provided by the merchant, the merchant's information controls.

SaveCrazyDeals has no obligation to honor, provide, reimburse, replace, or compensate you for any deal, coupon, discount, price, product, or service offered by a third-party merchant.

3. Third-Party Merchants and Purchases

SaveCrazyDeals generally helps users discover third-party offers. We are not a party to transactions between you and third-party merchants unless we expressly tell you otherwise.

We do not control third-party merchants and are not responsible for their acts or omissions.

This includes issues involving:

payment or billing;
product quality or authenticity;
warranties;
fulfillment;
shipping or delivery;
damaged or defective goods;
cancellations;
returns or exchanges;
refunds;
chargebacks;
merchant customer service;
merchant privacy or security practices;
merchant insolvency or closure;
injuries or property damage associated with products or services; or
any dispute between you and a merchant.

Any such issue should be addressed directly with the applicable merchant or payment provider.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU ASSUME THE RISKS ASSOCIATED WITH TRANSACTING WITH THIRD-PARTY MERCHANTS DISCOVERED THROUGH THE SERVICES.

The appearance of a merchant, brand, product, service, offer, or link on SaveCrazyDeals does not necessarily constitute an endorsement, recommendation, certification, verification, warranty, or guarantee by SaveCrazyDeals.

4. Affiliate Links, Advertising, and Compensation

SaveCrazyDeals may receive commissions, referral fees, advertising revenue, or other compensation when users click certain links, visit merchants, make purchases, register for services, or take other actions.

Some links appearing through the Services may therefore be affiliate or compensated links.

Compensation may influence whether, where, or how certain merchants, products, services, or offers appear through the Services.

Our receipt of compensation does not mean that we guarantee or assume responsibility for a merchant, deal, product, service, price, transaction, or claim made by a third party.

Additional disclosures may appear near particular links, offers, or content.

5. Services Provided “As Is”

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL INFORMATION, CONTENT, DEALS, LINKS, PRICES, ALERTS, NOTIFICATIONS, RECOMMENDATIONS, FEATURES, SOFTWARE, AND MATERIALS AVAILABLE THROUGH THE SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.”

TO THE FULLEST EXTENT PERMITTED BY LAW, SAVeCRAZYDEALS DISCLAIMS ALL WARRANTIES AND REPRESENTATIONS, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.

We do not warrant that the Services will:

operate without interruption;
always be available;
be error-free;
be completely accurate;
meet your requirements;
be secure;
be free of viruses, malware, or other harmful components; or
continue to offer any particular feature.

We also do not guarantee delivery or timing of deal alerts, emails, push notifications, or other communications.

Some jurisdictions do not permit the exclusion of certain warranties. Where applicable, the exclusions in these Terms apply only to the maximum extent permitted by law.

6. Your Responsibility

You are solely responsible for deciding whether to act on information displayed through the Services.

Before completing a transaction, you should independently review and verify the merchant's:

current price;
product or service description;
availability;
applicable restrictions;
shipping charges;
taxes and fees;
refund and cancellation policies;
warranty;
privacy practices; and
other applicable terms.

Your reliance on information obtained through the Services is at your own risk.

7. Accounts and Account Security

If we offer accounts, you agree to provide accurate information and keep your information reasonably current.

You are responsible for safeguarding your login credentials and for activity occurring through your account to the extent permitted by applicable law.

You may not impersonate another person, use another person's account without authorization, or create accounts through unauthorized automated means.

You should notify us promptly at Support@savecrazydeals.com if you believe your account has been compromised.

8. Eligibility

The Services are not directed to children under 13.

If you have not reached the age of legal majority where you live, you may use the Services only with the involvement and permission of a parent or legal guardian where required by applicable law.

9. Acceptable Use

You may not:

use the Services for unlawful purposes;
commit or facilitate fraud;
interfere with or disrupt the Services;
attempt to gain unauthorized access to systems or accounts;
introduce malicious software or code;
circumvent security or technical restrictions;
use unauthorized automated tools to scrape, crawl, harvest, or systematically extract information from the Services;
manipulate deal rankings, ratings, reviews, referrals, promotions, or other features;
impersonate another person or organization;
infringe intellectual-property, privacy, publicity, or other rights;
copy or commercially exploit substantial portions of the Services without authorization; or
use our proprietary content or databases to create or operate a competing commercial service except as permitted by applicable law or our written permission.

We may restrict, suspend, or terminate access when we reasonably believe these Terms have been violated or when reasonably necessary to protect the Services, SaveCrazyDeals, our users, merchants, or third parties.

10. Intellectual Property

The SaveCrazyDeals Services, including our original software, interfaces, logos, designs, graphics, databases, compilations, and content, are owned by or licensed to SaveCrazyDeals and are protected by applicable intellectual-property laws.

Subject to these Terms, SaveCrazyDeals grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable right to access and use the Services for lawful personal use.

Nothing in these Terms transfers ownership of SaveCrazyDeals intellectual property to you.

Names, trademarks, photographs, descriptions, and other materials belonging to third parties remain the property of their respective owners.

11. User Content

If the Services allow you to submit deals, comments, photographs, reviews, feedback, messages, or other material (“User Content”), you remain responsible for your User Content.

You represent that you have the necessary rights to submit it and that your submission does not violate applicable law or another person's rights.

By submitting User Content, you grant SaveCrazyDeals a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, modify, publish, display, distribute, and otherwise use the User Content in connection with operating, improving, providing, and promoting the Services.

We may moderate or remove User Content at our discretion, subject to applicable law.

12. Third-Party Websites and Services

The Services may link to websites, applications, merchants, advertisers, and services that SaveCrazyDeals does not own or control.

Your interaction with a third party is governed by that third party's own terms, policies, and practices.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAVeCRAZYDEALS IS NOT RESPONSIBLE FOR THIRD-PARTY WEBSITES, APPLICATIONS, CONTENT, PRODUCTS, SERVICES, AVAILABILITY, SECURITY, PRIVACY PRACTICES, OR CONDUCT.

13. Privacy

Our collection, use, and disclosure of personal information is described in the SaveCrazyDeals Privacy Policy, available through the Privacy Policy page on SaveCrazyDeals.com.

The Privacy Policy should be reviewed together with these Terms.

14. Mobile Applications

Subject to these Terms and any applicable app-store terms, SaveCrazyDeals grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable right to install and use our mobile application on devices that you own or control.

Except where applicable law provides otherwise, you may not reverse engineer, decompile, disassemble, modify, reproduce, distribute, sell, rent, lease, sublicense, or commercially exploit our application without our written permission.

15. Apple App Store

If you obtain the SaveCrazyDeals iOS application through Apple's App Store and SaveCrazyDeals has not provided a custom end-user license agreement for the application, Apple's then-applicable Standard End User License Agreement (“Apple Standard EULA”) applies to your license and use of the iOS application.

These SaveCrazyDeals Terms govern your relationship with SaveCrazyDeals and your use of the SaveCrazyDeals Services and are additional to the applicable Apple Standard EULA.

To the extent there is an unavoidable conflict concerning the license to the iOS application itself, the applicable Apple Standard EULA will control with respect to that license.

Your use of Apple's App Store and Apple devices is also subject to applicable Apple terms and policies.

16. Google Play and Other App Stores

If you obtain the SaveCrazyDeals application through Google Play or another application marketplace, your use of that marketplace and downloaded application may also be subject to the applicable marketplace provider's terms.

The app-store provider is not responsible for transactions between you and third-party merchants discovered through SaveCrazyDeals except to the extent expressly provided under the app-store provider's own terms or applicable law.

17. Changes, Errors, and Availability

We may modify, add, remove, suspend, or discontinue any part of the Services at any time, subject to applicable law.

We may correct pricing information, typographical errors, technical errors, merchant-feed errors, broken links, or other inaccuracies at any time.

The existence of incorrect information on the Services does not create an obligation for SaveCrazyDeals to provide, sell, procure, honor, reimburse, or otherwise fulfill the referenced deal, product, service, discount, or price.

We do not guarantee continued availability of any feature, merchant, promotion, deal, account, website functionality, or mobile application functionality.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAVeCRAZYDEALS AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, OWNERS, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OR FOR ANY LOSS OF PROFITS, REVENUE, SAVINGS, DATA, GOODWILL, BUSINESS OPPORTUNITY, OR USE ARISING OUT OF OR RELATED TO THE SERVICES.

This limitation includes, without limitation, losses arising from or relating to:

incorrect, misleading, expired, or unavailable deals;
inaccurate pricing or savings information;
failed coupons or promotional codes;
unavailable inventory;
delayed or missed alerts;
merchant acts or omissions;
merchant fraud or misconduct;
defective, counterfeit, unsafe, delayed, or undelivered products;
third-party purchases;
third-party websites or applications;
unauthorized access to accounts or information;
interruptions or errors in the Services;
loss or corruption of information;
reliance on information displayed through the Services; or
inability to access or use the Services.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF SAVeCRAZYDEALS AND THE OTHER PARTIES IDENTIFIED ABOVE FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

(A) $100; OR

(B) THE AMOUNT YOU ACTUALLY PAID DIRECTLY TO SAVeCRAZYDEALS FOR USE OF THE SERVICES DURING THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These limitations apply regardless of the legal theory asserted and even if SaveCrazyDeals has been advised of the possibility of damages or a remedy fails of its essential purpose.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless SaveCrazyDeals and its affiliates, owners, officers, employees, contractors, and agents from third-party claims, liabilities, damages, losses, and reasonable expenses arising out of or relating to:

your unlawful use of the Services;
your material breach of these Terms;
your User Content; or
your infringement or violation of another person's rights.

This provision does not require indemnification to the extent prohibited by applicable law.

20. Dispute Resolution and Binding Individual Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Informal Dispute Resolution

Before commencing arbitration, the party seeking relief must provide the other party with an individualized written notice describing the dispute, the relevant facts, and the requested relief.

Notices to SaveCrazyDeals must be sent to:

The parties will then have at least 60 days to attempt in good faith to resolve the dispute informally.

Binding Individual Arbitration

If the dispute is not resolved through the informal process, and except for disputes that qualify for small-claims court or other claims that applicable law permits to proceed outside arbitration, you and SaveCrazyDeals agree to resolve disputes arising out of or relating to these Terms or the Services through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules.

This arbitration agreement will be governed by the Federal Arbitration Act to the extent applicable.

The arbitrator may award individual relief available under applicable law.

Small-Claims Court

Either party may bring an individual action in a court of competent jurisdiction that qualifies as small-claims court instead of arbitration, provided the action remains individual and within that court's jurisdiction.

No Class or Representative Proceedings

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND SAVeCRAZYDEALS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, OR REPRESENTATIVE IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE-ATTORNEY-GENERAL, OR REPRESENTATIVE ACTION.

Jury-Trial Waiver

TO THE EXTENT A DISPUTE IS REQUIRED TO BE ARBITRATED, YOU AND SAVeCRAZYDEALS WAIVE THE RIGHT TO HAVE THAT DISPUTE DECIDED BY A JUDGE OR JURY IN COURT.

Arbitration Opt-Out

You may opt out of this arbitration agreement by emailing Support@savecrazydeals.com within 30 days after you first accept these Terms.

Your notice must include:

your full name;
the email address associated with your SaveCrazyDeals account, if applicable; and
a clear statement that you are opting out of the arbitration provision in the SaveCrazyDeals Terms of Service.

Opting out of arbitration will not, by itself, prevent you from using the Services.

21. New York Law and Courts

Except where federal law or non-waivable laws of another jurisdiction require otherwise, these Terms and disputes arising from them are governed by the laws of the State of New York, without regard to conflict-of-law principles.

For any dispute that is not subject to arbitration, you and SaveCrazyDeals consent to the jurisdiction of the applicable state and federal courts located in New York County, New York, except where applicable law gives you a non-waivable right to bring a claim elsewhere.

22. Changes to These Terms

We may revise these Terms from time to time.

When required by applicable law, we will provide appropriate notice of material changes.

The updated Terms will identify a new effective date.

Your continued use of the Services after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by applicable law.

23. Severability

If a provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law and the remaining provisions will remain in effect, except where applicable law requires otherwise.

24. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or another provision later.

25. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

SaveCrazyDeals may assign or transfer these Terms in connection with a merger, acquisition, reorganization, sale of assets, corporate restructuring, or by operation of law, subject to applicable law.

26. Entire Agreement

These Terms and any additional terms expressly incorporated into them constitute the agreement between you and SaveCrazyDeals regarding the subject matter addressed here and supersede prior agreements regarding that subject matter.

28. Reservation of Non-Waivable Rights

NOTHING IN THESE TERMS IS INTENDED TO WAIVE, DISCLAIM, RESTRICT, OR LIMIT ANY RIGHT, REMEDY, WARRANTY, OBLIGATION, OR LIABILITY THAT APPLICABLE LAW DOES NOT ALLOW TO BE WAIVED, DISCLAIMED, RESTRICTED, OR LIMITED.
